Work permits in Poland: check authority to work and lawful stay separately
For many non-EU nationals, the employer obtains the relevant work authorisation. That authorisation does not by itself establish lawful entry or residence, and changes to employer, role or conditions may matter.

Identify whether authorisation or an exemption applies
EU, EEA and Swiss citizens generally use free-movement rights, while third-country nationals commonly require a work permit, declaration, notification or a recognised exemption. The employer is responsible for many work-authorisation steps.
The document and the real work should match. Compare the employer, role, location, hours and other stated conditions before starting.
- Confirm the worker's lawful basis of stay
- Confirm the exact work-authorisation route or exemption
- Do not start until both the stay and work positions have been checked
Treat job changes as a new checkpoint
Changing employer, role, hours or other employment conditions can affect the existing authorisation. Record the proposed change before it happens and check current employer and worker notification or application duties.
Use current law, not an older Type A checklist
Poland introduced new foreign-employment legislation from 1 June 2025 and expanded electronic processes. Older articles may use superseded procedures or terminology, so open the current government or MOS source before acting.
Frequently asked questions
Who applies for a Polish work permit?
For the common employer-based route, the Polish employer applies. The worker should still verify lawful entry and stay, the conditions shown in the authorisation and any separate residence requirements.
Can I change employers using the same permit?
Often the employer and conditions are material. Check the specific authorisation and current rules before ending or beginning work; a new application or notification may be required.
Does a residence card always allow any work?
No. The effect depends on the type of permit, annotations, decision and applicable exemptions. Check the actual document and current official rules.
